Raleigh police have charged a man with first-degree murder and first-degree sex offense in connection with the death of a 10-month-old girl.Police responded to an emergency call about an unresponsive infant shortly before 9 p.m. Sunday at 1223-306 Silver Sage Drive, an apartment complex off Jones Franklin Road.
Paramedics transported the infant to WakeMed, where she was pronounced dead.
Joshua Andrew Stepp, 26, was charged Monday. Police said Stepp knew the victim but did not elaborate on their relationship.
Stepp was in the Wake County Jail Monday night on a $500,000 secured bond for the first-degree sex offense charge in the case. The murder charge carries no bond.
He is set to appear in court Tuesday.
“He (Stepp) was always to himself, and he never actually talked to me. Nor did I ever want to talk to him, because he just had that kind of demeanor to him. He just didn't want to talk,” said Brian Smith, who lives in the same complex as Stepp.
Smith said he witnessed paramedics entering the apartment Sunday night.
“About a minute or two after, they rushed out with the baby that was in the paramedic's hand. And you could tell the baby was lifeless, just like a rag doll,” Smith said.
“It is disgusting. It is sad. It is really sad,” Tigh Roberts, another neighbor, said of the crime.
The Fayetteville Police Department says it's charged a man with trying to solicit money in the name of Shaniya Davis. It says Donald Roddy, Jr., 36, of Hypony Trail, Parkton was seen in the area of McPherson Church Road and Skibo Road holding a piece of cardboard which said he was collecting money for Shaniya.
Police said he was attempting to collect money from passing motorists. When asked, he told one motorist that he was collecting money for the Fayetteville Police Department.
The Fayetteville Police Department says it's not collecting money on behalf of Shaniya Davis.
Roddy was charged by detectives with obtaining property by false pretenses. He was at the Cumberland County Detention Center under a $2000 bond.
Authorities in North Carolina said Wednesday that they will need to determine where the killing of a 5-year-old girl occurred before additional charges are filed in the case. The body of Shaniya Davis, who was reported missing in Fayetteville last week, was found Monday beside a road near Sanford, which is about 30 miles northwest of Fayetteville, police said.
The girl's mother, Antoinette Nicole Davis, has been charged with human trafficking and other offenses, and another suspect, Mario Andrette McNeill, has been charged with kidnapping in the case.
A Tuesday statement from the Fayetteville police says that jurisdiction is "governed by where the criminal conduct occurred. Right now, this is an ongoing investigation and as such we are still determining the details surrounding the death of the child."
On Wednesday, Fayetteville Police Chief Tom Bergamine said jurisdiction will need to be determined before other charges are filed.
He did not elaborate on what charges might be pending.
"Several of the details regarding the investigation have a direct impact on which county will assume jurisdiction and prosecute this case," Bergamine told reporters at a news conference.
"The district attorneys from the involved jurisdictions are discussing the matter and ultimately will make that decision," he said.
Fayetteville is in Cumberland County, while Sanford is in Lee County. The district attorneys from those counties did not immediately return phone calls seeking comment Wednesday.
Davis reported her daughter missing last week from their home in a mobile home park. According to police, surveillance video taken November 10 from a hotel in Sanford shows Shaniya in the company of McNeill.
"The investigation at this point indicates that Shaniya Davis was alive at the time she left the Sanford hotel," police said.
Following Davis' arrest over the weekend, police spokeswoman Teresa Chance said Davis had been "prostituting her child."
Shaniya's father, Bradley Lockhart, made a tearful appeal before reporters Tuesday afternoon, asking that "everybody makes it a point not to ignore, to look past a situation where a person, a child, or anybody might be in danger ... so that we don't have another tragedy like Shaniya."
Eyewitness News confirmed Tuesday that the mother of 5-year-old Shaniya Davis is pregnant. Jail officials in Cumberland County said for that reason, Antoinette Davis, 25, was being kept separate from the rest of the prison population. News of the pregnancy came a day after volunteers found the body of the missing girl in a wooded area near Sanford. She had been the focus of a nationwide Amber Alert since last week.
Antoinette Davis is accused of human trafficking, prostitution and felony child abuse in her daughter's disappearance. Warrants say she provided her daughter with intent that the girl be held in sexual servitude.
Davis showed no emotion during a court appearance in Fayetteville Monday afternoon and she did not enter a plea to the charges.
Shaniya's body was found in an area bordered by Highway 87 south and Walker Road - just south of Sanford - during a second day of searching.
Fayetteville police spokesperson Theresa Chance said the body of a child was located about 100 feet off the road. Police were waiting for a positive identification from the state medical examiner.
Crime scene investigators removed the little girl's body from the scene late Monday night. Detectives do not know if the child was killed in a different location than where the body was found.
Authorities are releasing few details about the findings or a cause of death.
The discovery wrapped up a search conducted by about 250 law enforcement officers and volunteers who used dogs, horses, and a helicopter to scour the woods after police got information about where to find the body.
Hundreds of people including Davis' father, Bradley Lockhart, came together Monday night to honor the little girl.
"I ask you to give me and everyone who loved poor Shaniya - my little baby, my angel - the strength to continue on," Lockhart told the crowd that gathered. He said a funeral for Shaniya would be held in Raeford once the body was released from the medical examiner's office in Chapel Hill.
Meanwhile, a makeshift memorial of toys, candles and flowers were left at the vigil off Murchison Road in Fayetteville in honor of Shaniya.
"I can't imagine this happening to my grandchild to my daughter, it's just sad so sad," Fayetteville resident Renee Tillman said.
Volunteers also held a candlelight vigil for the girl on Walker Road near where her body was found earlier in the day.
"It's not fair all the children to see violence right next to home and I hope she rest in peace and she's away from this evil world," volunteer Mary Belle Swann said.
"Like most people you have children or relatives that are young aged and you just want the best outcome. It's unfortunate that ended like it did," offered another volunteer Derrick Murchison.
"Davis' half-sister, Cheyenne Lockhart, talked to CNN Monday. She recalled Shaniya as a precious child and is stunned by her sister's death.
"She was just so loving, and caring," Cheyenne said. "She was always happy and giggling. You would never think somebody would do that to her. She's just the sweetest little girl."
Cheyenne said he knows Shaniya's mother and describes the woman as sweet. The teenager said she can't imagine Antoinette doing the things she's charged with doing.
Suspect in abduction arrested
Davis was last seen alive at a Comfort Suites hotel in Sanford last week - the same morning her mother reported her missing from her Fayetteville home. Police say a surveillance video from the hotel showed the child with 29-year-old Mario McNeill.The area where police found the body is about seven miles from the hotel.McNeill turned himself in Thursday night and police say he confessed to taking the 5-year-old. However, McNeill's attorney told reporters his client would plead not guilty.McNeill remains in jail. Police have not announced any new charges in the girl's death.
A missing 5-year-old whose mother was accused of offering her for sex was found dead off a heavily wooded road in a rural area Monday, ending a weeklong search, police said. Searchers found Shaniya Davis' body early Monday afternoon about 100 feet off a road southeast of Sanford, in central North Carolina, Fayetteville Police spokeswoman Theresa Chance said. She declined to comment on a cause of death or the condition of Shaniya's body.
"We've got a lot of people out at the scene right now that are torn up," Chance said. "Detectives have been running off adrenaline to find this little girl and to bring her home alive. You have a lot of people in shock right now."
Two people have been charged in her disappearance, one of them her mother, Antoinette Davis, 25. Police charged Davis with human trafficking and felony child abuse, saying Shaniya was offered for prostitution.
Davis was calm and quiet during a five-minute court appearance in Fayetteville on Monday afternoon. She provided one-word answers to the judge's questions and held her hands in front of her, without handcuffs. She requested a court-appointed attorney and did not enter a plea.
Her sister, Brenda Davis, 20, said outside that she does not believe the charges.
"I don't believe she could hurt her children," Brenda Davis said. The sisters were able to speak at the jail Sunday, and Brenda Davis recalled that her sibling said she would not do that to her daughter.
Authorities also charged Mario Andrette McNeill, 29, with kidnapping after they said surveillance footage from a Sanford hotel showed him carrying Shaniya there. Authorities said McNeill admitted taking the girl, though his attorney said he will plead not guilty.
Davis reported Shaniya missing Tuesday. Authorities first arrested a man named Clarence Coe, but charges against him were dropped a day later when investigators tracked down McNeill after receiving a tip from a hotel employee.
Additional information led investigators to a search site near Sanford on Sunday. They continued searching Monday, scouring miles of landscape, roads, ravines and fields on four-wheelers and with helicopters.
After Shaniya's body was found, a solemn group of searchers met quietly at a nearby fire station to ensure that all volunteers were accounted for.
"We were hoping that someone could carry her home," said Syd Severe, 42, who came from Raleigh to help with the search. "It's just sick."
A cluster of emergency vehicles and law enforcement personnel gathered where Shaniya's body was found, about a quarter mile from N.C. Highway 87. Authorities blocked access to the road, a rural area popular with hunters that is less than a mile from a large lakeside community.
Shaniya's father, Bradley Lockhart, said he raised his daughter for several years but last month decided to let her stay with her mother. He had pleaded for her safe return.
"I should've never let her go over there," he told The Associated Press on Saturday.
Before Shaniya's body was found, he said on CBS's "The Early Show" Monday that he remained hopeful someone would bring his daughter somewhere safe, such as a police station or hospital.
"They can drop her off at Walmart, I don't care," he said.
A man who answered the phone at the Lockhart home Monday afternoon declined to comment

The neighbor of the man, who was arrested Saturday night after the bodies were found, said the police had done little, despite the calls.
Fawcett Bess, 57, the owner of Bess Chicken and Pizza, across the street from the house, said that about two weeks ago, he found the man, Anthony Sowell, in the bushes alongside Mr. Sowell’s house naked and standing over a woman who was bloodied, beaten and also naked. Mr. Bess called 911, he said, and an ambulance soon took the woman away. But the police showed up two hours later and never interviewed him, he said.
“Nobody did anything because she is a girl walking around the streets,” Mr. Bess said. He said he did not know what had happened to the woman, or if the police had followed up on the matter.
Mr. Bess said that a month earlier, he had been approached by another woman who showed him bruises and blood on her neck that she claimed were from an attack by Mr. Sowell. The woman told Mr. Bess that the police had taken a report but appeared to do little investigating, he said.
“If people had come to tell us about this guy’s history, then maybe we would have paid more attention,” he said.
The claims were supported by police records that indicate Mr. Sowell was accused by one woman of choking and raping her in his house on Sept. 22. It was after this accusation that the police decided to conduct the search in which they found the decaying bodies. Police records indicate it took several weeks to assign an officer to the case and to obtain a search warrant.
Police records also show that on Dec. 8, 2008, another woman filed a report accusing Mr. Sowell of stopping her in front of his house and forcing her to the back door, where he punched, choked and tried to rape her.
“There were several incidents at the house that we were aware of, and we have investigated everything we had heard about,” Lt. Thomas Stacho, a spokesman for the Cleveland Police Department, said. “We are doing everything we can.”
Detectives were struggling Monday to identify the six bodies. They brought in cadaver dogs to search for more bodies, and met with the families of missing local women to gather information.
The discovery of the bodies led some crime experts to question whether the methods of tracking convicted sex offenders were sufficient. “It’s not clear what the answer is,” said Kristen Anderson, who oversees the sex offender tracking team at the National Center for Missing and Exploited Children.
Ms. Anderson said the Sowell case raised questions that were also raised in the case of Jaycee Dugard, the young California girl who was kidnapped and held for 18 years. The man charged with kidnapping her, Phillip Garrido, was also a convicted sex offender. The police visited him regularly to confirm his whereabouts.
“As a society, we’re still debating where the acceptable line is between an offender’s rights and privacy versus public safety,” Ms. Anderson said.
Like Mr. Garrido, Mr. Sowell seemed to have followed all the reporting requirements.
After serving 15 years in state prison for choking and raping a woman, Mr. Sowell, 50, registered with the state as a sex offender when he moved into the neighborhood in 2005, and he began checking in regularly with law enforcement authorities, as required by state law.
Former tabloid reporter Kate Major is dishing the details of her brief fling with Jon Gosselin, and how they had to sneak sex when the kids were around.
Kate 2.0, one of a bevy of young women Gosselin's been seen with since announcing his divorce from Kate Gosselin, sounded off on him in Life & Style magazine.
"Jon said he couldn't be seen having a girlfriend, so he told me to drive to a neighbor's house after midnight, when the kids were asleep," Major told the mag. "He said he'd pick me up on his four-wheeler, take me to his house and drop me off again at 6 a.m.
"I was shocked and said, 'No, I don't feel right doing that. What if the kids wake up?' He was like, 'They're not going to notice, they're not going to see anything.' He wasn't nervous about it — I was."
Despite her hesitance, Major didn't seem to have much of a problem cavorting with the father of eight.
"He was a great kisser," she said. "It was amazing. I said, 'I've never felt like this about anybody else in my life,' and he said, 'Me too.'"
Major, who left her job at Star magazine after falling for Gosselin while working on a story about him, also discussed his relationship with Hailey Glassman.
The 22-year-old daughter of Kate Gosselin's plastic surgeon, Glassman seems to be back on with Gosselin since he got sidetracked with Major.
"Jon never wanted to use his credit card — he was worried that he'd get caught or spotted. On July 20, we went to a hotel in New Jersey," Major said. "I paid for the room, and he snuck up a back way. That was the first time we slept together. He said he was falling in love with me. He said, 'I thought Hailey was perfect until I met you.'"
Major added, "Even when we were in the Hamptons, we were planning to go to L.A. together to meet with Christian Audigier about Ed Hardy stuff. We also talked about going to Las Vegas. Now he's taking Hailey — and that was a trip we had planned together."
According to the 26-year-old bottle blonde, Gosselin told her at one point he was going to Massachusetts to break up with Glassman.
But when he left her side on June 23, the octodad shut his phone off. When he finally called Major back, he said he needed to be single.
"Looking back, it was all pretty much sexual," she said. "That's what he had in mind. I'm deeply upset by the turn of events. He totally screwed me over and acted like a dirtbag."
The biggest slap of all – Gosselin finally got rid of her with a text message reading, "Do not contact me again."
Omarosa Manigault-Stallworth, known for her in-your-face antics on "The Apprentice" and other reality shows, is scheduled to begin her studies at United Theological Seminary in Dayton on Monday.
Ivan Hicks, the school's associate dean for African-American studies, says Omarosa will spend about two years pursuing a doctor of ministry degree.
Hicks says the Youngstown, Ohio, native has a heart for Christian ministry and has done work on behalf of the homeless and the poor in Haiti.
He says Omarosa's reputation for both good and bad will help her as a minister, because people will relate to her.
ROCKY MOUNT, N.C. — They spent their nights jumping in and out of strange cars, trolling otherwise empty streets lined with decaying storefronts and boarded-up homes. Many sold sex to support drug habits or children left in the care of worried, hardworking grandmothers.
Even when they were picked up for drugs or prostitution, nights in jail looming, they called home to let their families know they were OK. Then, one by one, the calls stopped.
Since 2005, nine women who lived at the edges of the poor community in this small North Carolina city have disappeared. Six bodies were found along rural roads just a few miles outside town, most so decomposed that investigators could not tell how they died. At least one of the women was strangled, and all the deaths have been classified as homicides. Three women are still missing.
Police will not say whether they suspect a serial killer, but people in the community about 60 miles northeast of Raleigh do, and they're impatient with law enforcement efforts to investigate the slayings.
After the latest body — that of 31-year-old Jarneice Hargrove — was found in June behind a burnt-out house that was once a crack den, local law enforcement and state police formed a task force. In July, the FBI got involved.
But friends and family say it didn't happen soon enough.
"We got someone out here that's snatching up females," said Stephanie Jones, a 28-year-old nursing student. "I mean, next person could be your grandmother, it could be me, it could be my mother, it could be my daughter."
Jones, who knew two of the victims, has founded a group that is raising money to publicize the slayings and search for those still missing. She says the cases are being swept under the rug because of the victims' lifestyles.
The lead investigator, Sheriff James Knight, said he cannot comment.
Rumors swirl about the identity of the killer, if there is just one. Some say he is an ex-military man or an ex-police officer because he leaves no evidence. Others believe he is exacting revenge on local women after contracting HIV from a prostitute.
Forensic psychologist Dr. Michael Teague said the killings are probably the work of one person.
"You're talking about a man who didn't finish high school, probably doesn't have a regular job, probably not married or in a stable relationship," he said.
Vivian Lord, chairwoman of the criminal justice department at the University of North Carolina at Charlotte, said that if one killer is responsible, he is likely trying to cleanse the world of prostitutes or deliberately picking victims he knows won't be missed.
If it's the latter, he chose wrong when he killed Ernestine Battle. Her sister, Tynatta James, 64, remembers the February 2008 day the family reported Battle missing. It had been less than 48 hours since they last heard from the 50-year-old, but she always checked in, even from jail.
"We knew something wasn't right because she hadn't called," James said.
A month later, a man putting up a wire fence around his property down a rural stretch of road outside town found a badly decomposed body. The bodies of two other victims were found in the same area in 2007 and 2009.
In May, a DNA test identified the remains as Battle's. She was wearing only her underwear and police told James she was probably strangled, but they couldn't be sure because animals had dragged away a small throat bone that typically breaks when someone is killed that way.
"I'm still frustrated," James said. "I didn't really feel like they were doing all they could. I just feel like they recently started to get involved in the cases after the last lady."
For Alecia Johnson, the killings were a wake-up call. She knew most of the women: They all walked the streets of Rocky Mount together. She said she didn't wait for police to catch a killer. She stopped after the body of the first woman, 29-year-old Melody Wiggins, was found dumped in the woods in 2005.
"I used to walk these streets and jump in and out of cars. But then when that first girl Melody got killed I stopped that because I knew he would kill another," said Johnson, 41. "I hate for that to happen to her, but it probably saved my life. I have five babies."
Counting the names on one hand, she added, "There's probably five or six girls left around here that will jump in and out of cars. He really did kill the whole neighborhood."
Jones' group has raised enough money to post billboards with the faces of the missing and slain women. Now she is raising more to organize search teams for those whose bodies have not been found.
Juray Tucker, the mother of 37-year-old Yolanda Lancaster, missing since February, said she wants to help with fundraising but doesn't get much time now that she has to care for her daughter's children.
"Every day, every minute, every hour, I'm worried," she said. "It's constant on my mind and there ain't nothing I can do, ain't nothing I can do."
